These Terms of Use ("Terms") are a legal agreement between you and KinderVerse ("KinderVerse", "we", "us", or "our") governing your access to and use of kinderverse.io and our apps (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old and the parent or legal guardian of any child who uses the Service. You are responsible for all activity under your account, for keeping your login secure, and for supervising your children's use. Child profiles are managed by you and are not separate accounts.
2. Subscriptions, billing & renewals
Paid plans are billed in advance through our payment processors (Stripe or PayPal). Unless stated as a one-time purchase (e.g., Lifetime), subscriptions automatically renew at the end of each billing period at the then-current price until cancelled. You can cancel anytime from your account or by contacting us; cancellation stops future renewals and remains in effect until the end of the current period. Prices may change with prior notice.
3. Free trial & refunds
Free features and any free stories are provided "as is" with no payment required. For paid plans, we offer a 14-day money-back guarantee on your first purchase of a plan. Refund requests should be sent to contact@kinderverse.io. Physical print orders that have already entered production or shipped are non-refundable except where defective or damaged.
4. Physical books & shipping
Keepsake and printed books are produced and shipped by third-party print-on-demand partners. Delivery times, shipping costs, and availability vary by location. Risk of loss passes to you on delivery to the carrier. We are not responsible for carrier delays.
5. AI-generated content
Stories, images, lessons, affirmations, and narration may be generated using artificial intelligence. While we design strong safeguards for child-appropriate output, AI can occasionally produce unexpected results. Content is provided for entertainment and educational purposes and is not professional, medical, psychological, or therapeutic advice. Please review content and use parental judgement.
6. Your content & license
You retain ownership of content you upload (such as drawings or voice recordings). You grant us a limited, worldwide, royalty-free license to host, process, and use that content solely to operate and provide the Service to you (for example, to generate personalised stories or narration). You represent that you have the rights to any content you provide.
7. Our intellectual property
The Service, including characters, software, designs, and original content, is owned by KinderVerse or its licensors and protected by law. We grant you a personal, non-transferable, non-exclusive license to use the Service for your family's personal, non-commercial use. You may not copy, resell, scrape, or reverse-engineer the Service.
8. Acceptable use
You agree not to misuse the Service, including by attempting to access it unlawfully, disrupting it, infringing others' rights, uploading harmful or unlawful content, or using it to generate content that is illegal or harmful. We may suspend or terminate accounts that violate these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDERVERSE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless KinderVerse from claims, damages, and expenses arising out of your misuse of the Service or violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users. Sections that by their nature should survive termination will survive.
13. Governing law & changes
These Terms are governed by applicable law in our place of operation, without regard to conflict-of-law rules. We may update these Terms from time to time; material changes will be notified by email or within the Service, and continued use means acceptance.
